UpNext’s The Retail Playground Membership Terms & Conditions

Welcome to The Retail Playground (the “Community”) by UpNext (the “Company”). We provide a vibrant community for retail entrepreneurs and professionals to connect, collaborate and grow. By clicking, “I agree” and joining, as the business owner, your business or brand and you (collectively, “Member”) agree to these Terms and Conditions (Agreement). Please read them carefully.

In these Terms and Conditions, “We” means UpNext. “You/your” means you as a user of the Website and/or Customer of the Program/Services.

Membership Eligibility

• Member must be 18 years or older and legally able to enter into contracts.
• Member must be in good legal standing and compliant with all applicable laws and regulations.
• Member cannot be involved in multi-level marketing (MLMs) or franchising businesses.

Member Code of Conduct
Members must abide by the Community Guidelines. Failure to comply with the Community Guidelines may result in suspension or termination of your membership.

Membership Fees
A recurring membership fee applies. You will be automatically billed on the date you joined for the time period you selected. Membership fees are non-transferable and cannot be shared with other individuals or businesses.

Payments
Membership fees are paid by credit card. Members will be billed each period for their membership until Member cancels their membership. Discounted membership rates may be offered in special one-time offers. These discounted membership rates do not apply to previous payments. 

Automatic Renewal
All memberships renew automatically for successive periods (monthly, quarterly, annually or for other periods within the scope of special offers) and are charged to the card on file until Member cancels their membership. You accept responsibility for all recurring charges processed prior to cancellation, including, where applicable, any charges processed after the expiration date of their payment card.

In the event a Member’s card is declined, Member will be required to provide an updated credit card for payment processing.

Refunds + Cancellations
All Memberships fees are non-refundable. Membership fees are paid in advance and are not refunded in whole or in part. You may cancel your membership at any time by logging into your account, or contacting UpNext at [email protected]. Membership will terminate at the end of the period covered by the most recently paid membership fee.

Refusal of Service
UpNext reserves the right to refuse service to any order, person or entity without obligation to assign reason for doing so. UpNext reserves the right to limit the number of participants in any given program, event or class. 

Right to Terminate
We reserve the right to terminate your membership at any time for any reason, including, but not limited to, violation of our Terms and Conditions or inactivity. We will provide you with reasonable notice before termination.

Right to Change Membership Benefits
We reserve the right to modify the membership benefits, fees and other terms at any time. We will provide you with notice of any changes.

Use of Data
We collect and use your data to personalize your experience, improve our services, and communicate with you. We will not share your data with third parties without your consent, except as required by law.

All content provided in the Community and its corresponding Website, including all courses, products and materials are the intellectual property of UpNext or its licensors. The content of the Website and Service are protected by United States trademark, trade dress and copyright law. You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the content of the Site or the Service, in whole or in part without our prior written consent. You may not remove any trademark, copyright, or other notice from the content of the Site or the Service.

Restrictions + Non-Compete
You may not use Community resources or information for unauthorized purposes. You may not copy or infringe upon Company or Community trademarks or intellectual property. You agree not to compete with the Company or Community or engage in activities that may harm our business.

Reporting Issues
If you encounter any issues within the Community, please report them to our support team, or via email to [email protected]. We will investigate reported issues promptly and take appropriate action.

Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Massachusett, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms will be resolved exclusively in the courts of the Commonwealth of Massachusetts.
